📝Popular justice Book Synopsis : This popular one-volume analysis of the evolution of American criminal justice places contemporary issues of crime and justice in historical perspective. Walker identifies the major periods in the development of the American system of criminal justice, from the small institutions of the colonial period to the creation of the police, the prison, and the juvenile court in the nineteenth century and the search for professionalism in the twentieth century. He argues that the democratic tradition is responsible for the worst as well as the best in the history of criminal justice in the United States. Offering a challenging perspective on current controversies in the administration of criminal justice in light of historical origins, the author explores the evolving conflict between the advocates of crime control and the advocates of due process. Now in its second edition, Popular Justice has been completely revised to include the most recent scholarship on crime and justice. Walker has updated his analysis of the history of American criminal justice and explores the tension between popular passions and the rule of law. He examines changing patterns in criminal activity, the institutional development of the system of criminal justice, and the major issues concerning the administration of justice. Timely and comprehensive, this text will be useful for courses in criminal justice, legal history, and criminology.

📝U S Latinos and Criminal Injustice Book Synopsis : Latinos in the United States encompass a broad range of racial, socioeconomic, and sociopolitical identities. Originating from the Caribbean, Spain, Central and South America, and Mexico, they have unique justice concerns. The ethnic group includes U.S. citizens, authorized resident aliens, and undocumented aliens, a group that has been a constant partner in the Latino legal landscape for over a century. This book addresses the development and rapid growth of the Latino population in the United States and how race-based discrimination, hate crimes, and other prejudicial attitudes, some of which have been codified via public policy, have grown in response. Salinas explores the degrading practice of racial profiling, an approach used by both federal and state law enforcement agents; the abuse in immigration enforcement; and the use of deadly force against immigrants. The author also discusses the barriers Latinos encounter as they wend their way through the court system. While all minorities face the barrier of racially based jury strikes, bilingual Latinos deal with additional concerns, since limited-English-proficient defendants depend on interpreters to understand the trial process. As a nation rich in ethnic and racial backgrounds, the United States, Salinas argues, should better strive to serve its principles of justice.

📝Criminal Conversations Book Synopsis : "The essays in this book set out to explore the ways in which Victorians used newspapers to identify the causes of bad behavior and its impacts, and the ways in which they tried to "distance" criminals and those guilty of "bad" behavior from the ordinary members of society, including identification of them as different according to race of sexual orientation. It also explores how threats from within "normal" society were depicted and the panic that issues like "baby-farming" caused." "Victorian alarm was about crimes and bad behavior which they saw as new or unique to their period - but which were not new then and which, in slightly different dress, are still causing panic today. What is striking about the essays in this collection are the ways in which they echo contemporary concerns about crime and bad behavior, including panics about "new" types of crime. This has implications for modern understandings of how society needs to understand crime, demonstrating that while there are changes over time, there are also important continuities."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc. 📝Expert Evidence and Scientific Proof in Criminal Trials Book Synopsis : Forensic science evidence and expert witness testimony play an increasingly prominent role in modern criminal proceedings. Science produces powerful evidence of criminal offending, but has also courted controversy and sometimes contributed towards miscarriages of justice. The twenty-six articles and essays reproduced in this volume explore the theoretical foundations of modern scientific proof and critically consider the practical issues to which expert evidence gives rise in contemporary criminal trials. The essays are prefaced by a substantial new introduction which provides an overview and incisive commentary contextualising the key debates. The volume begins by placing ?forensic science? in interdisciplinary focus, with contributions from historical, sociological, Science and Technology Studies (STS), philosophical and jurisprudential perspectives. This is followed by closer examination of the role of forensic science and other expert evidence in criminal proceedings, exposing enduring tensions and addressing recent controversies in the relationship between science and criminal law. A third set of contributions considers the practical challenges of interpreting and communicating forensic science evidence. This perennial battle continues to be fought at the intersection between the logic of scientific inference and the psychology of the fact-finder?s ?common sense? reasoning. Finally, the volume?s fourth group of essays evaluates the (limited) success of existing procedural reforms aimed at improving the reception of expert testimony in criminal adjudication, and considers future prospects for institutional renewal - with a keen eye to comparative law models and experiences, success stories and cautionary tales.

📝The Psychology and Law of Criminal Justice Processes Book Synopsis : Psychological science now reveals much about the law's response to crime. This is the first text to bridge both fields as it presents psychological research and theory relevant to each phase of criminal justice processes. The materials are divided into three parts that follow a comprehensive introduction. The introduction analyses the major legal themes and values that guide criminal justice processes and points to the many psychological issues they raise. Part I examines how the legal system investigates and apprehends criminal suspects. Topics range from the identification, searching and seizing to the questioning of suspects. Part II focuses on how the legal system establishes guilt. To do so, it centres on the process of bargaining and pleading cases, assembling juries, providing expert witnesses, and considering defendants' mental states. Part III focuses on the disposition of cases. Namely, that part highlights the process of sentencing defendants, predicting criminal tendencies, treating and controlling offenders, and determining eligibility for such extreme punishments as the death penalty. The format seeks to give readers a feeling for the entire criminal justice process and for the role psychological science has and can play in it.

📝Hearsay Evidence in Criminal Proceedings Book Synopsis : The Criminal Justice Act 2003 re-wrote the hearsay evidence rule for the purpose of criminal proceedings, enacting the recommendations of the Law Commission together with some proposals from the Auld Review. In 2008, Professor Spencer wrote a book explaining the new law, intended for practitioners as well as academics. Following the style of his earlier book about the new law on bad character evidence, the core of the hearsay book was a section-by-section commentary on the relevant provisions of the Act, discussing the case law that had interpreted them. Since the appearance of the first edition, the new law on hearsay evidence has been the subject of a spectacular exchange between the UK Supreme Court and the European Court of Human Rights, the effects of which the Court of Appeal has interpreted in several leading cases. In this new edition, the commentary is revised to take account of these developments. As in the first edition, the commentary is preceded by chapters on the history of the hearsay rule, and the requirements of Article 6(3)(d) of the European Convention on Human Rights. It is followed by an appendix containing the text of the statutory provisions and a selection of the leading cases.

📝A General View of the Criminal Law of England Book Synopsis : Stephen, Sir James Fitzjames. A General View of the Criminal Law of England. London and Cambridge: Macmillan and Co., 1863. xii, 499 pp. Reprint available February, 2005 The Lawbook Exchange, Ltd. 1-58477-478-9. Cloth. $95. * Reprint of the first edition. Stephen [1829-1894] explores English law exclusive of penal actions, of offences punishable by summary proceedings before magistrates and of special offences intended as sanctions for special statutory institutions but including all other acts commonly known as crimes. In a discussion of a later edition Holdsworth observed: "it was probably the best modern history of a particular branch of English law that had yet appeared in England. It won high praise from Pollock and Maitland.... Though the more intensive study of the earlier history of our law has rendered some parts of it obsolete, it is still the best history of the later stages of the law. And it has another merit which it can never lose. The fact that its author was a practising lawyer and a judge, gives to his account of many parts of the law, and especially to his analysis of famous trials, the reality and vividness which comes of practical experience.": The Historians of Anglo-American Law 77-78.

📝Foundational Texts in Modern Criminal Law Book Synopsis : Foundational Texts in Modern Criminal Law presents essays in which scholars from various countries and legal systems engage critically with formative texts in criminal legal thought since Hobbes. It examines the emergence of a transnational canon of criminal law by documenting its intellectual and disciplinary history and provides a snapshot of contemporary work on criminal law within that historical and comparative context. Criminal law discourse has become, and will continue to become, more international and comparative, and in this sense global: the long-standing parochialism of criminal law scholarship and doctrine is giving way to a broad exploration of the foundations of modern criminal law. The present book advances this promising scholarly and doctrinal project by making available key texts, including several not previously available in English translation, from the common law and civil law traditions, accompanied by contributions from leading representatives of both systems.
